1. General Provisions

By sending an order the Buyer gives consent to the Terms and Conditions quoted by the Vendor for the purchase of goods through the website www.brella.cz. These terms and conditions are obligatory for both contracting parties (i.e. Buyer and Vendor).

2. Price of goods

The marked prices are final, the Vendor is not a VAT registered entity. By sending an order the Buyer accepts the price quoted by the Vendor. If the Vendor changes the price after the time the Buyer sends the order, the Vendor is obliged to inform the Buyer about the change in short order, entitling thereby the Buyer to decide whether he will accept the newly quoted price or withdraw from the order.

3. Order confirmation and withdrawal

By sending an order by means of the order form on the website www.brella.cz the order becomes binding. By completing the form the Buyer orders goods specifications of which are quoted on the website www.brella.cz in the detailed specifications of the item. In the event of ambiguity the Buyer will be immediately contacted by phone or by e-mail. The Buyer can withdraw from an order without specifying any reason before dispatching the goods via telephone or e-mail.

4. Terms of Delivery and Delivery Period

The goods is standardly dispatched within two working days through Czech Post (Česká pošta). The standard delivery period of a consigment is 2-3 working days.

5. Warranty

The Vendor provides a warranty for goods for a period of 24 months in accordance with applicable legislation. The Buyer is entitled to claim the purchased goods within 14 days without specifying any reason and withdraw from the purchase agreement. The Buyer can assert a claim only in case the goods is unimpaired and in the original packaging. After the Vendor receives and inspects the goods he is entitled to deduct the expenses related to the delivery (i.e. postage and packing), and subsequently will return the price difference to the Buyer by sending the price amount to the Buyer’s account. The warranty is not applicable to defects caused by routine use, improper treatment or improper storing.

6. Complaints

Potential complaints will be processed in accordance with legislation applicable in the Czech Republic. The Buyer must check the goods after receiving it in order to detect possible defects or damage. In case of any defect found the Buyer is obliged to notify the Vendor either in writing, by e-mail or by phone.

7. Uncollected consignments

Upon dispatching a consignment the Buyer will be informed by e-mail and undertakes the responsibility for collecting the consignment. In case of not collecting the consignment in time the Vendor is entitled to claim the expenses for the postage and packing. If the Buyer requires resending the consignment, the Vendor will charge for the expenses connected with the postage and packing of the uncollected consignment as well as the resent consignment.

8. Personal Data Protection Policy

The owner of the internet shop operated on www.brella.cz archives and processes personal data pursuant to Act. No. 101/2000 Coll. on Personal Data Protection and its later regulations. Personal data are protected from publishing and misuse by a third party. They are used exclusively for: sending the ordered goods; communication with the customer; and promotional purposes provided that the customer gave his consent.
